Tbilisi Mathematical Journal Institutional License

This license is an agreement between the publishers Tbilisi Mathematical Journal Publications (TMJP) and subscribing institutions. It concerns rights to the electronic versions of the publications of TMJ. To register rights under this agreement please print it and mail or fax a signed copy to the publishers at the address given at the bottom.

Agreement

Tbilisi Mathematical Journal Publications is wholly owned by National Centre for Science and Technology. TMJP's aim is to provide broad electronic dissemination of high-quality research while enabling libraries to archive its publications and assure their permanent availability. To this aim, all TMJP publications are produced in electronic and paper format at the lowest possible price, with highest possible quality and with the widest possible access.

Rights: TMJP grants the Subscriber access to the TMJP database for scholarly and educational purposes by the faculty, staff, students, distance learners, alumni, on-site library users, and registered patrons utilizing the Subscriber's campus network. Users may download and print articles for personal use and archive contents on their own personal computers. They may send copies of individual articles by email, print, or fax to persons at other locations for their personal use. Facsimile images that are exact representations of the print journal pages or of printouts from the electronic database may be provided for interlibrary loan under CONTU guidelines and distributed in paper, fax, or digital form.

Nothing in this Agreement shall limit the rights of the subscriber or an Authorized User to make a fair use, or otherwise exercise rights under the copyright act and case law, of TMJP.

Archiving: Upon receipt of payment or institutional purchase order, the Subscriber may download and archive materials at its own site and place contents on its own file server, including electronic reserves. There are no restrictions on access to this material beyond those described in the section above on "Rights."

Warranty:
A) TMJP will use reasonable efforts to provide continuous service and to ensure that its server(s) have sufficient capacity and rate of connectivity to provide the Subscriber with a quality of service comparable to current standards in the subscriber's locale.
B) TMJP warrants that it has the right to license the rights granted to the subscriber and that use of the content in the TMJP database shall not infringe the copyright of any third party.
C) Except as noted above, TMJP publications are provided "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.

General:
This Agreement constitutes the entire agreement between the parties and may be amended only by a written instrument signed by both parties.
